These Platform Terms and Conditions (“Terms”) govern your access to and use of the SecurityAudit360 service platform (“Platform”) and website (“Site”). SecurityAudit360 is referred to as “SecurityAudit360”, “we”, “us” or “our”. “You” or “your” refers to any person or entity using the Platform.
By using the Platform or Site, you expressly agree to and accept all the terms and conditions contained herein. If you object to or do not accept any of these Terms, you must not use this Platform.
1. Nature of the Services
SecurityAudit360 provides continuous website security auditing, vulnerability intelligence, and digital risk monitoring services. Our ratings are calculated using publicly available data collected through passive scanning techniques. We do not use intrusive techniques, attempt to bypass security controls, or access Customer internal systems.
2. Access to Platform
Right to Use. Subject to your compliance with these Terms, SecurityAudit360 grants you a non-exclusive, non-transferable, revocable right to access and use the Platform for your internal business purposes.
Restrictions. You shall not:
- Interfere with or disrupt the integrity or performance of the Platform.
- Attempt to gain unauthorized access to the Platform or its related systems.
- Copy, modify, distribute, or create derivative works of any portion of the Platform.
- Disassemble, decompile, or reverse engineer the Platform.
- Use the Platform for any unlawful purpose.
3. User Information and Data
You retain all rights to any intellectual property you enter into the Platform (“User Information”). By submitting User Information, you grant SecurityAudit360 a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that information solely for the purpose of providing the Services to you.
Any personal information collected by or provided to SecurityAudit360 will be treated in accordance with our Privacy Policy.
4. Proprietary Rights
The Platform, including all data, reports, and information accessed on the Platform, and all Intellectual Property Rights therein, remain the exclusive property of SecurityAudit360 and its licensors. You acknowledge that SecurityAudit360 may collect usage data in connection with your use of the Platform to improve our products, provided such data is anonymized and does not identify you.
5. Disclaimers
THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SECURITYAUDIT360 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SECURITYAUDIT360 BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUES, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM. SECURITYAUDIT360’S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SECURITYAUDIT360 IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100) IF NO SUCH PAYMENTS WERE MADE.
7. Indemnification
You agree to indemnify and hold harmless SecurityAudit360 from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Platform or your breach of these Terms.
8. General Provisions
Governing Law. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SecurityAudit360 is legally established, without regard to its conflict of law provisions.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Modifications. SecurityAudit360 reserves the right to revise these Terms at any time. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
